Terms and conditions

1. Scope and acceptance

You must be at least 18 and legally able to contract. An automated receipt is not final acceptance; Motion may verify identity, inventory, price, payment, delivery details and fraud risk.

2. Products and real-world performance

Images are illustrative. Range, speed and performance vary with load, rider weight, terrain, slope, weather, tire pressure, maintenance and riding style. Manifest pricing or specification errors may be corrected before acceptance, with the option to confirm or cancel.

3. Price, IVA and shipping

Published prices are shown before IVA. Applicable IVA is calculated and visibly added at checkout before payment is confirmed. Checkout discloses product pricing, discounts and IVA. Shipping is quoted separately and must be shown and accepted before it is charged. USD is charged when stated; CRC is a dated reference.

4. Full payment and advance orders

The full product price and applicable IVA are paid upfront when the purchase is confirmed. Deposit payments and balances due at delivery are not offered. Shipping is quoted and charged separately. When a product is marked as an advance order, its specific terms, estimated delivery window and accepted legal version are retained with the order.

5. Imports and external delay

Preorder and import arrival dates are estimates based on available information. Manufacturing, departure from China or another origin, container availability, carriers, ports, customs, authorities, weather, labor events, trade restrictions and force majeure may affect them.

To the maximum extent permitted by law, Bimba is not liable for lost profit, lost opportunity, unauthorized expense or indirect loss arising exclusively from external events reasonably beyond its control where it acted in good faith, took commercially reasonable steps and provided timely information.

An estimate does not override an expressly agreed deadline. If it cannot be met, Motion will propose a revised date. The customer may expressly accept it or, where the law provides, cancel for a full refund without deduction. Silence is not acceptance.

6. Delivery, returns and warranty

Customers must provide an exact address; changing it invalidates the shipping quote. The commercial 14-day return applies only to unopened, unused products. The commercial limited warranty is one year. Mandatory defect, conformity, incorrect-delivery and withdrawal rights remain unaffected.

7. Safety and liability

Customers must follow the manual, use authorized charging equipment, inspect the vehicle and obey applicable road rules. Unauthorized speed, battery, controller or structural modifications are prohibited.

To the maximum extent permitted, Bimba’s aggregate contractual liability is limited to proven direct loss and the amount actually paid for the affected product. Bimba is not liable for indirect, incidental, special, punitive, or consequential loss, including loss of use, business, revenue, goodwill, opportunity, or profit, where that exclusion is legally valid.

Nothing excludes fraud, wilful misconduct, gross negligence, legally attributable injury, mandatory defective-product liability, expressly promised remedies, or non-waivable rights.

8. Complaints and law

Complaints are free through hello@motioncr.com or +506 6358-1026. Costa Rican law applies without depriving consumers of mandatory forums or remedies. Invalid provisions are severed without invalidating the remainder.
